If you’re a survivor of sexual assault or trafficking and you’ve waited years — or even decades — to speak up, you are not alone. And you may still have legal options.
At GOLDLAW, we know how trauma, shame, fear, and silence can delay justice. Florida law recognizes this too — and in many cases, it gives survivors more time than they think to file a civil lawsuit.
Why Do Survivors Wait?
Survivors of sexual violence often delay disclosure for very real reasons:
- They were threatened or manipulated
- They didn’t realize it was abuse
- They felt ashamed or blamed themselves
- They feared not being believed
- They repressed or minimized the trauma
- They weren’t emotionally ready
Coming forward is not easy. But it’s never too late to learn your rights — and we’re here when you’re ready.
Florida’s Statute of Limitations for Sexual Abuse and Trafficking Cases
In Florida, the time limit to file a civil lawsuit — known as the statute of limitations — depends on your age at the time of the abuse and the nature of the case:
- For survivors who were under 16 at the time of the abuse: there is no statute of limitations in many civil sexual abuse cases
- For adult survivors, the clock may start from the date they discovered (or should have discovered) the injury caused by the abuse
- For sex trafficking, the federal Trafficking Victims Protection Reauthorization Act (TVPRA) allows up to 10 years to file a civil claim, and longer in some cases
Every case is different — that’s why it’s critical to speak with a trauma-informed attorney to evaluate your specific circumstances.
Delayed Reporting Does Not Disqualify You
Your credibility does not depend on when you speak out. Courts — and juries — increasingly understand the psychological and emotional effects of trauma. Delayed disclosure is common, not suspicious.
